Ethan Carlyle has over two decades of experience litigating lawsuits, arbitrations, and administrative proceedings in Texas and other states. His recent focus includes complex business and commercial litigation and personal injury and property damage litigation, including product liability, premises, trucking and negligence matters, and he has represented clients in a variety of matters including:

  • Defending steel pipe and tube manufacture in commercial litigation matter related to an alleged exclusivity agreement. Ethan obtained a summary judgment for his client at the trial court and successfully argued for an affirmance at the U.S. Fifth Circuit Court of Appeals in New Orleans, Louisiana, which resulted in a published opinion in Sheet Pile, L.L.C. v. Plymouth Tube Co., 98 F.4th 161, 163 (5th Cir. 2024).
  • Defense of one of the country’s largest providers of security systems and services in personal injury, negligent security, and premises lawsuits in Texas.
  • Defense of major airline in three-week trial in Santa Monica, California regarding multi-million-dollar lawsuit that alleged breach of an implied contract regarding an in-flight entertainment portal. Obtained a complete defense verdict for the airline, which was affirmed on appeal.
  • Argued drilling contractor’s position in Denver, Colorado to the U.S. Chemical Safety and Hazard Investigation Board with respect to a drilling incident.
  • Represented an industrial cleaning contractor in an administrative law proceeding before the Federal Mine Safety and Health Review Commission in Corpus Christi, Texas where a favorable settlement was obtained before the Secretary of Labor rested.
  • Obtained a judgment for $2.9 million after a two-week trial on behalf of a Houston-based fuel trader against Canadian entities and their principal based on fraudulent transfer and alter ego theories.
  • Defended an insurer in a two-week first-party insurance trial in federal court in the Northern District of Texas and was the drafter of the winning Renewed Motion for Judgment as a Matter of Law that completely overturned a $9 million-plus verdict and resulted in the 144-page opinion, which was affirmed on appeal at Mid-Continent Cas. Co. v. Eland Energy, Inc., 709 F.3d 515, 517 (5th Cir. 2013).

Mr. Carlyle received his J.D. from South Texas College of Law where he served as an Articles Editor for the South Texas Law Review and was a Langdell Scholar who tutored first year law students over the weekends. He received his Bachelor of Arts in Business Administration and Philosophy from Trinity University.
