Fellows of the foundation are selected for their professional achievements and their commitment to the improvement of the justice system throughout Texas. Each year the top one-third of 1 percent of Texas attorneys are invited to become fellows. Selected nominees must then be elected by the Texas Bar Foundation Board of Trustees.  

The group funds projects that provide legal services for the underserved, public education about the law, and the promotion of ethics in the legal profession.

Houston City Council Settles Fire Department Discrimination Lawsuit, Agrees to Federal Consent Decree https://azalaw.com/houston-city-council-settles-fire-department-discrimination-lawsuit-agrees-to-federal-consent-decree/ Wed, 14 Oct 2020 18:53:43 +0000 https://azalaw.com/?p=7988 HOUSTON – The Houston City Council has settled an employment discrimination lawsuit filed by Houston firefighter Jane Draycott in a case that started in 2009 when racist and sexist slurs were scrawled across her belongings, including on a photo of her dead daughter.

Ms. Draycott received $275,000 from the city as part of the settlement, along with a court-approved federal consent decree in which the city promises to create sexual harassment and retaliation training for ranking Houston Fire Department personnel and supervisors.

“This was a long struggle but worth it for Jane because she obtained relief through the courts that will help other women going forward,” said Joe Ahmad, co-founding partner of AZA and Ms. Draycott’s lawyer. “She stood on the side of truth and justice in this case.”

As part of the agreement, the city must provide training on its harassment policies, prohibitions, obligations for ranking firefighters and how to investigate complaints. The federal government must approve the training materials.

The purpose of the decree is to “provide general, non-monetary remedies that ensure that the City does not discriminate against any HFD employee on the basis of sex or retaliate against an employee in violation of Title VII.”

The harassment that Ms. Draycott and an African American female firefighter suffered included threatening sexist and racist graffiti in the female dorm, urine sprayed on female dorm toilets, and a male firefighter grabbing a female firefighter and rubbing up against her and climbing into her bed. When Ms. Draycott tried to return to work after reporting the incident, she was mistreated with silence and abuse. The city of Houston denied there were race and gender discrimination problems.

“I want to be treated like everybody else,” she said on her third attempt to return to work in 2010. “I want to be able to go to work and not be harassed, not be retaliated against.”

Mr. Ahmad said this long fight was hard but worthwhile. “The way the male firefighters treated these brave women was abhorrent. The city dragging its feet a decade on this was shameful. But thanks to the EEOC (Equal Employment Opportunity Commission) and the federal government intervening and getting this solid consent decree, justice has been done here,” Mr. Ahmad said.

The case is United States of America v. City of Houston and Jane Draycott v City of Houston in the Southern District of Texas U.S. District Court case no. 4:18-cv-00644.

AZA Client FlexSteel Pipelines Wins Appellate Ruling on Jurisdiction Over Chinese Company  https://azalaw.com/aza-client-flexsteel-pipelines-wins-appellate-ruling-on-jurisdiction-over-chinese-company/ Fri, 11 Sep 2020 14:48:33 +0000 https://azalaw.com/?p=7946 HOUSTON – The Texas 14th Court of Appeals has ruled that AZA client FlexSteel Pipelines Technology Inc. can proceed to trial against a Chinese company and its Houston-based employee for theft of trade secrets.

The appellate court found that a Harris County trial judge did not err by allowing a special appearance by China-based Changchun Gaoxiang Special Pipes Co., LTD, which employed a former employee of the predecessor of FlexSteel Pipelines. That former employee is also accused of stealing trade secrets about a pipeline product for use in offshore oil and gas work.

“This is a great win for FlexSteel. The Chinese company was arguing it shouldn’t be subject to the Harris County courts even though it pays for an employee to live here in Houston where he stole the pipeline trade secret at issue,” said AZA of counsel Kevin Leyendecker, who handled the case with AZA co-founding partner John Zavitsanos.

AZA worked on the appeal with Houston lawyers Robert (Randy) Roach and Daniel Davis of Roach Newton LLP.

The appellate case is Changchun Gaoxiang Special Pipes Co., LTD v. Flexsteel Pipeline Technologies, Inc., case number 14-18-01107-CV. The dispute can now proceed to trial in the 234th Civil District Court in Harris County. The trial court case is Flexsteel Pipeline Technologies, Inc., v. Chen, Bin et al. case number 2015-52962.

Mr. Bai represents plaintiffs and defendants in a variety of forums and involving different technologies. His clients range from tech companies to oil drillers. As one example, he successfully represented a U.S. tech company in the international enforcement and licensing of speech coding patents that included the filing of more than 25 cases in China. He has degrees in physics engineering and economics.  

 

Mr. Byrd litigates breach of contract, noncompete agreements, trade secrets and patent infringement cases. In his first four years of practice, he tried five cases with claims and counterclaims in excess of $1 million, including two trial victories as the first-chair lawyer. In 2018, Mr. Byrd was one of only six associates in the U.S. recognized for “best in client service” by BTI Client Service All-Stars. 

 

Mr. Campbell has navigated challenging trials from the beginning of his career. One of his first cases involved winning a $7.8 million jury verdict in a business disparagement case that received national news coverage. In 2018, Mr. Campbell successfully defended a motion for summary judgment on an eight-figure claim, in which he primarily drafted the briefing and argued the defense at the judgment hearing.  

 

Mr. Chen has represented clients in federal courts across the country in patent infringement disputes involving semiconductor processing, flash memory products, integrated circuit packaging and electronic lighting controls. His practice also includes counseling on copyrights and trademarks. He has a degree in electrical and computer engineering. 

 

Mr. Flores is a combat veteran and graduate of the U.S. Military Academy at West Point. He has tried 26 cases to verdict with 16 of those as lead counsel. A former JAG officer, his experience includes lead counsel on significant national security cases. He has represented clients in everything from labor and employment disputes to wrongful death claims and construction disputes.  

 

Mr. Rowinsky focuses on complex civil litigation with a practice that includes contract disputes, employment disputes, tort claims, trade secrets, and oil and gas litigation. He has also maintained an active pro bono practice from his time in law school and has assisted clients with employment discrimination and civil rights claims. 

 

Mr. Sarkar has experience resolving a broad range of business disputes, including claims in the hundreds of millions of dollars. He has handled breach of fiduciary duty and fraud claims, whistleblower cases, trade secret and noncompete clause litigation, and lawsuits in the oil patch and the construction industry. He was named Outstanding Young Lawyer of Texas for 2019 by the Texas Young Lawyers Association. 

 

Mr. Talanov’s practice focuses on intellectual property matters, including patent and trade secret litigation involving a variety of technologies, such as oilfield drilling and completion tools, smart phones and medical devices. Before becoming a lawyer, he worked for five years as a process engineer focused on oil and gas and petrochemicals, employed by a global oil company and an engineering firm.

TeamHealth Emergency Physician Group Wins $9.4 Million Arkansas Jury Verdict for Underpayment by Centene Corporation https://azalaw.com/teamhealth-er-doctors-group-wins-9-4-million-arkansas-jury-verdict-for-underpayment-by-centene-corporation/ Wed, 19 Aug 2020 17:08:15 +0000 https://azalaw.com/?p=7842 LITTLE ROCK, Ark. – A six-person jury on Tuesday awarded a $9.4 million verdict on behalf of Southeastern Emergency Physicians, LLC, an affiliate of TeamHealth Inc., finding that Centene Corporation and Ambetter, Novasys and Celtic, its commercial insurance subsidiaries, systematically tried to strip the 120 emergency clinicians in the physician’s group of most of their pay.

In one of the first in-person jury trials in Arkansas since the COVID-19 virus hit, the jury in U.S. District Judge Brian S. Miller’s court found that the defendants grossly underpaid and breached their agreement with the emergency room doctors. The jury awarded $9.4 million in damages and the judge added an additional $1.24 million in attorneys’ fees and costs. It is in the 2020 Top 100 Verdicts as calculated by Verdict Search. It is also a 2020 Top 10 Verdict nationally for the year so far.

“The Centene defendants tried to cheat these hardworking emergency room doctors. They treated commercial insurance claims like Medicare payments, they tried to hide which company owed the money, they paid late. This lawsuit is one of many TeamHealth has filed against various insurers across the country to stop systematic underpayment of ER doctors’ groups by insurance companies, that seek to keep the money for their own coffers. The legal team was hired only six days before this Arkansas trial. A similar Houston case is scheduled to be tried soon by Mr. Zavitsanos and his team. TeamHealth is trying to level the playing field for these key doctors that support multiple communities but whose practice groups are being badly underpaid by several highly profitable insurance companies.

The jury found that the Centene-controlled commercial insurance company and health network since 2014 had paid the emergency clinicians’ groups only 20% of the amount they were owed for their services.  The jury also heard how Centene tried to obfuscate their ownership of the companies and the entities responsible for paying the doctors.  “Communities depend on their ER doctors, and insurance companies cheating them out of their livelihood is not only fraudulent, it’s dangerous,” said TeamHealth co-counsel Collin D. Kennedy of Frisco, Texas-based Hanshaw Kennedy Hafen, LLP.

TeamHealth is a physician-led, patient-focused company founded by doctors, for doctors. Arkansas Health & Wellness Health Plan, Inc.; Celtic Insurance Company d/b/a Arkansas Health & Wellness Insurance Company; Novasys Health, Inc., and Centene Corporation, in the U.S. District Court for the Eastern District of Arkansas, Case No. 4:17-cv-492-KGB.

Three AZA partners were also recommended by IAM Patent 1000 – The World’s Leading Patent Professionals 2020. The new guide said of the AZA lawyers: “They keep the whole case in view and get great results. Feedback from the IAM research staff about the firm included: “AZA is a firm of top-notch patent litigators who excel at trial work – when they get up to handle witnesses and present legal arguments, they have this uncanny ability to convince judge and jury that they are right whatever the circumstances.” 

This year’s issue cited AZA partners Amir Alavi and Demetrios Anaipakos as leading patent litigation lawyers, calling them “exceptional.” These two head the AZA intellectual property and patent team and have been honored on this list since 2016. New to the list this year is partner Todd Mensing, who focuses on all types of commercial litigation including intellectual property and patent cases.
